These Terms and Conditions apply to music lesson services provided by Sing Education Limited of 10 Towerfield Road, Essex, SS3 9QE (“Sing Education”).
These Terms and Conditions were last updated in [Month Year]. By purchasing or continuing to receive lessons from Sing Education, the Parent and Student agree to be bound by these Terms and Conditions.
Small group and one-to-one tuition is delivered in lessons of up to 30 minutes on school premises during term time, for up to 38 weeks per academic year.
All tuition is organised to take place during the school day between 9:00am and 3:30pm.
All timetables, invoices and communications are distributed via the My Music Staff portal and email. Further information regarding lessons and billing can be accessed through the Student Portal at www.singeducation.co.uk/studentportal. Login details can be requested by emailing instrumental@singeducation.co.uk.
Groups are formed according to pupil age and ability. Due to the nature of group tuition, varying skill levels may be present within any group lesson.
Lessons are invoiced one month in advance. For example, lessons taking place in January will be invoiced on 1 December. Lessons for the new academic year commencing in September will be invoiced on 1 July.
If an invoice remains unpaid after its due date, Sing Education reserves the right to suspend lessons until payment has been received in full.
Sing Education reserves the right to review and amend its lesson fees from time to time to reflect increases in operating costs, inflation, market conditions, staffing costs, or other business requirements.
Where lesson fees are increased, Sing Education will provide no less than 30 days’ written notice before the revised fees take effect.
If the Parent does not wish to continue lessons at the revised rate, they may terminate tuition by providing written notice to Sing Education before the effective date of the fee increase. Lessons received before the termination date shall remain payable in full.
Sing Education sends automated lesson reminders approximately 48 hours before each lesson. A minimum of 24 hours’ notice is required to cancel a lesson.
Any lesson missed by the Student without at least 24 hours’ notice shall remain chargeable and will not be refunded, credited or rescheduled.
If a Teacher is unavailable to deliver a scheduled lesson, Sing Education will endeavour to provide a suitable cover Teacher. If this is not possible, the lesson will be rescheduled. Where rescheduling cannot reasonably be arranged, any fees paid for the affected lesson will be credited towards future lessons or refunded.
Sing Education schedules lessons around known school closures wherever reasonably possible. However, individual pupil absences, school trips, examinations, assessments and other activities may occasionally conflict with scheduled lessons.
Where a Parent is aware of such a conflict, they must notify Sing Education at least 24 hours before the scheduled lesson in order for alternative arrangements to be considered.
All students and/or their parents or guardians must maintain a valid payment method on file with Sing Education.
By making an online payment, the account holder authorises Sing Education to securely store payment details and automatically collect all tuition fees, lesson fees and any other amounts due on the applicable invoice due date.
The account holder is responsible for ensuring that payment information remains accurate and up to date at all times.
If an automatic payment is declined, fails, or if any invoice remains unpaid after its due date, Sing Education reserves the right to suspend or pause all lessons and services until the outstanding balance has been paid in full and a valid payment method has been provided.
Sing Education shall not be responsible for any lessons missed or learning opportunities lost as a result of lessons being suspended due to overdue or failed payments. Suspended lessons will not be rescheduled, credited or refunded unless otherwise agreed in writing by Sing Education.
Sing Education reserves the right to amend its billing procedures and payment requirements upon providing reasonable notice to students and/or their parents or guardians.
Parents must provide an instrument for the Student to use during lessons, with the exception of piano and keyboard lessons.

The Parent is responsible for arranging and maintaining insurance cover for the Student’s instrument and any related equipment.
The Student shall not make photocopies of copyrighted music or otherwise copy, reproduce, distribute or transfer any materials, resources, teaching content or intellectual property belonging to Sing Education or the Teacher without prior written permission.
Examination entries, festivals, competitions and similar events shall only be entered where the Student, Parent and Teacher are in agreement.
Any examination, competition or festival entry fees shall be the responsibility of the Parent unless otherwise agreed in writing.
In the interests of the Student’s safety and wellbeing, the Parent must inform Sing Education and the Teacher of any relevant medical condition, learning need or other circumstance that may affect the Student during lessons.
Sing Education complies with all applicable data protection legislation, including the UK General Data Protection Regulation and the Data Protection Act 2018.

Sing Education shall not be liable for any mistake, error of judgment, act or omission made in good faith and within the scope of these Terms and Conditions.
Students bring musical instruments and other personal property to lessons and activities at their own risk. Sing Education accepts no responsibility for loss of or damage to such property except where such loss or damage results directly from the negligence of Sing Education or where liability cannot be excluded by law.
Sing Education’s total liability arising under these Terms and Conditions shall not exceed the total fees paid by the Parent during the preceding 12 months.
Sing Education shall not be liable for any indirect, consequential or special losses.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.
Sing Education will undertake appropriate Disclosure and Barring Service (DBS) checks for individuals working with Students where required by law. However, Sing Education does not warrant or guarantee any individual’s suitability beyond compliance with applicable safeguarding requirements.
Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, war, civil unrest, strikes, lockouts, flood, fire, epidemic, pandemic or government restrictions.
Teachers will use their reasonable skill and care and best endeavours to assist the Student’s musical development.
Musical progress depends upon many factors, including attendance, engagement and regular practice. Accordingly, neither the Teacher nor Sing Education guarantees any particular level of progress, examination result or musical achievement.
